A BILL to amend article three, chapter five-a of the code of West Virginia, one thousand nine hundred thirty-one, as amended, by adding thereto a new section, designated section sixteen-a, creating a natural gas contract refund fund; providing permissible expenditures from the fund; and requiring expenditures to be made pursuant to appropriation.

Be it enacted by the Legislature of West Virginia:
That article three, chapter five-a of the code of west Virginia, one thousand nine hundred thirty-one, as amended, be amended by adding thereto a new section, designated section sixteen-a, to read as follows:

ARTICLE 3. PURCHASING DIVISION.

§5a-3-16a. Creating the natural gas contract refund fund and permissible expenditures.

All moneys received as refunds by the state pursuant to any agreements with vendors providing natural gas shall be deposited in a special revenue fund designated the "natural gas contract refund fund," which is hereby created in the state treasury to be administered by the department of administration. All expenses of the purchasing division of the department of administration incurred in the implementation of state-wide natural gas contracts shall be paid from the fund. Expenditures from the fund are not authorized from collections but shall be made upon appropriation by the Legislature in accordance with the provisions of article three, chapter twelve of this code and upon fulfillment of the provisions of article two, chapter five-a of this code.
